Terms and Conditions

Dalmatia Care · draft version 2026-11-01

Working draft — ordering is not active yet.

Before launch, the provider details, tax treatment, final prices and travel costs, payment and scheduling terms, applicable out-of-court dispute resolution and contact information must be completed. These terms do not yet constitute an offer to enter into a contract. Applicable law and mandatory national information will be finalised according to the actual provider and customers.

1. Provider and customer

Dalmatia Care is a service brand of ŠVARC PROJECT MANAGEMENT d.o.o. za usluge, OIB 05942749080, MBS 040484097, registered office: Škuncini stani - samorašnji 100, 53291 Novalja, Croatia, registered with Trgovački sud u Rijeci. This company is the sole contracting provider. Identification details were verified in the Croatian Court Register on 1 November 2026.

Email for orders, complaints and withdrawal: hello@dalmatiacare.com. Postal address: the provider’s registered office stated above. Telephone: +420 603 583 151.

Customers may be consumers or businesses. A consumer is a natural person acting outside their trade or profession; providing a company registration number or owning a rental property does not automatically determine this status. The statutory 14-day withdrawal provisions apply to consumers.

2. Services and scope

Services include cleaning suitable upholstery and mattresses, lounger and daybed cushions, property checks and separately agreed hot tub maintenance. The exact scope, quantities, price, address and date or binding service period must be determined before binding submission.

Cleaning methods depend on the material and manufacturer’s instructions. Removal of all stains, mould, odours or existing damage cannot be guaranteed. This does not limit liability for defective work. The provider will inform the customer if cleaning is unsuitable; changes to scope and price require agreement.

A property check covers agreed accessible areas and equipment. It does not replace specialist inspections, a structural assessment or comprehensive diagnosis of hidden defects. Measurements, repairs and servicing beyond the agreed scope require a separate agreement.

3. Estimates and contract formation

The calculator’s “from” prices are preliminary estimates only. A binding order cannot be submitted until the final price, including all taxes and known costs, is determined. Individually priced hot tub care and travel outside the covered area must first be included in a specific quote.

In the active ordering system, customers will review services, quantities, place and timing, contact details, the final total, payment terms and, for recurring services, duration and termination before submission. Errors can be corrected by returning to the form. Agreement to the Terms is given through a separate, initially unchecked box.

A contract and obligation to pay the agreed price arise when the customer clicks “Order with obligation to pay” and the order is successfully received by the provider’s system. Clicking alone, opening an email app or generating order text does not constitute receipt. The provider will promptly email a confirmation, order number, summary, accepted Terms and withdrawal information in a form the customer can save. Technical confirmation of receipt is not an additional approval of price or scope.

A requested date must not be presented as reserved without checking availability. If the system has no verified date or agreed service period, it will allow only a non-binding enquiry.

4. Prices, discount and payment

Customers may choose bank transfer against an invoice, cash on site, card on site using the provider’s own terminal, or online card payment via Stripe once enabled. The invoice will state the IBAN and payment due date; the due date must also be disclosed before a binding order. Selecting a payment method does not make a payment.

For private customers receiving these services in Croatia, 25% VAT applies. Business orders require individual confirmation of the tax treatment according to the service and customer.

Amounts are in EUR. Base prices exclude VAT; applicable tax is added after the discount and any minimum callout adjustment. Before ordering is enabled, the price list must clearly show final prices including applicable VAT or state that the provider does not charge it. Current draft “from” prices are not final prices for binding orders.

A 5% discount applies automatically when the subtotal of ordered one-off services exceeds €200 excluding VAT. No discount applies at exactly €200. The discount is calculated in euro cents and rounded to the nearest cent. It excludes travel, separately agreed materials and the monthly fee. Following an agreed scope change, the calculation is updated and the customer approves the revised summary.

The minimum one-off callout value is €89 excluding VAT, including travel within Biograd. Any adjustment to the minimum is shown separately. Travel to surrounding areas must be priced before binding submission. No extra work or surcharges are charged without the customer’s prior agreement.

Postseason offer: bookings for upholstery cleaning confirmed by 30 November 2026 include a free basic property check of up to 30 minutes. This is not the standalone check of up to 60 minutes. The basic check’s scope is stated on the offer page.

To be completed before launch: payment method and due date, any deposit and its due date. Customers must receive these details in the summary before submission.

5. Access, cooperation and performance

The customer must arrange authorised access at the agreed time and provide relevant information about equipment, materials and known defects. Access through a property manager may be agreed. Water, electricity, ventilation and drying-time requirements will be communicated in advance. Keys and access codes are transferred through an agreed secure method.

The provider will perform the agreed work with professional care and supply the agreed documentation. Photos should record the work and findings; personal belongings and documents should not be photographed. Marketing use of property or personal photographs requires separate authorisation, which is not a condition of service.

6. Rescheduling and cancellation

Both parties will notify the other of any obstacle without undue delay. A replacement date and any scope change must be expressly agreed. This draft does not impose an automatic cancellation fee or forfeiture of the full price. Statutory rights and the consumer’s withdrawal right remain unaffected.

7. Consumer withdrawal within 14 days

For a service contract concluded at a distance, consumers generally have the right to withdraw without giving reasons within 14 days of conclusion. Notice must be sent to the provider by email or post before the deadline. The model below may be used but is optional.

An express request to start within 14 days is recorded separately from acceptance of the Terms. If the consumer then withdraws, a proportionate payment for services actually provided up to notice of withdrawal may be due under statutory conditions, provided proper information was given. The withdrawal right ends only when the service is fully performed, if performance began with prior express consent and acknowledgement that full performance would end that right. Acceptance of the Terms alone does not have this effect.

On a valid withdrawal, payments received will be refunded without undue delay, no later than 14 days after notice, by the same payment method unless otherwise agreed at no additional cost. Only a lawful claim for work already provided will be taken into account. Other statutory consumer rights remain unaffected.

8. Complaints and liability

Complaints can be submitted using the provider’s contact details, identifying the order and defect, with photographs if appropriate. The provider will acknowledge receipt and handle the complaint within applicable statutory deadlines. Specific mandatory procedures and deadlines must be completed before launch according to the provider and applicable law.

Customers retain statutory remedies for defective performance, including rectification and, where legal conditions are met, a price reduction or withdrawal. These Terms do not exclude liability for damage caused by the provider or limit mandatory customer rights.

9. Regular checks

The draft offer of €89/month excluding VAT includes two visits of up to 30 minutes each. Before a binding order, the start, duration, billing, termination rules, carry-over of unused visits and any travel costs must be specified. Until then, this is an enquiry only; automatic renewal is not assumed.

10. Personal data and disputes

Identification, contact and order data are processed as necessary to conclude and perform the contract and comply with legal obligations. Before activation, separate information will be available about the controller, recipients, retention and customer rights. Marketing consent is not a condition of ordering.

The relevant consumer dispute-resolution body and its contact details will be added according to the actual provider. Any choice of law must not deprive consumers of mandatory protection. No restriction is agreed on the right to apply to a competent court.
